The U.S. Department of Agriculture (USDA) regulations require substitutions or modifications in school meals for children whose disabilities restrict their diets. According to the Rehabilitation Act of 1973, the Americans with Disabilities Act (ADA) of 1990, and the ADA Amendments Act (ADAAA) of 2008, a person with a disability is defined as any person with a physical or mental impairment that substantially limits one or more major life activities or major bodily functions. Food allergies fall under the definition of disability clarified by the ADAAA of 2008.
PWCS must provide modifications for children on a case-by-case basis when requests are supported by a written statement signed by a state licensed medical authority.
Each special dietary request must be supported by a Dietary Modification Medical Statement Form signed by a state licensed healthcare professional, including a licensed physician, physician's assistant, or nurse practitioner. The Medical Statement must include:
Please give the signed medical statement to the Food Service Manager at your student’s school. Unfortunately, if we do not receive a signed medical statement, we may not be able to provide the substitutions your child needs.
Soy milk is available for students who cannot drink cow's milk due to a milk allergy, lactose intolerance, ethical or religious beliefs, or other special dietary needs. Parents/guardians must provide a written request for the soy milk substitution. A medical statement is not required.
